1. Who we are

This website is operated by Balgowlah Seafood PTY LTD (ACN 684 020 175, ABN 29 684 020 175), a fresh and cooked seafood retailer trading from Shop 16, 197–215 Condamine Street, Balgowlah Village Shopping Centre, Balgowlah NSW 2093.

In this policy, "we", "us" and "our" mean Balgowlah Seafood PTY LTD. "You" means anyone who visits this website, places an order, or contacts us through it.

We handle personal information in line with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth). This policy explains what we collect, why, and what control you have over it.

2. What personal information we collect

We collect only what we need to take your order and get it to you.

When you place an order

  • Your name
  • Your email address
  • Your phone number
  • Your delivery address, if you choose delivery rather than pickup
  • The items you ordered, and your chosen pickup or delivery date and time
  • Anything you write in the order notes field — please don't put sensitive information there

When you send us a message

  • Your name, email address, and phone number if you provide one
  • The content of your message

Automatically, when you browse

  • Standard web server logs kept by our hosting provider — your IP address, browser type, the pages you visited and when. These are generated by the hosting infrastructure, not by us, and we do not use them to identify individuals.

We never ask for, see, or store your card details. No payment is taken on this website. There are no card fields anywhere on it, and no payment processor is connected to it. Pickup orders are paid in the shop when you collect. Delivery orders are paid by bank transfer into our business account, which happens in your own banking app — we see only that a payment arrived and the reference you quoted, exactly as we would for any bank transfer.

3. How we collect it

We collect personal information directly from you — when you fill in the order form, send us a message through the contact page, phone us, or speak to us at the counter. We do not buy personal information from third parties, and we do not build profiles about you from outside sources.

4. Why we collect it

We use your personal information to:

  • Prepare and fulfil your order
  • Contact you to confirm the order, or if something you asked for isn't available that day
  • Deliver your order to the right address
  • Answer questions you send us
  • Keep basic records of sales, as required for tax and business purposes
  • Send you news about specials and seasonal produce, but only if you have asked us to (see Marketing emails below)

We do not use your information for any purpose unrelated to the ones above without asking you first.

5. Who we share it with

We do not sell your personal information. We never trade or rent it. We share it only with the service providers that make the website work, and only to the extent they need it:

  • Web3Forms — delivers your contact-form message, and the notification that an order has come in, to our shop inbox. Those contents pass through their service en route to us.
  • Hostinger — hosts this website and keeps the server logs described above.
  • Supabase — your order details are stored in a Supabase database so our team can see and prepare the day's orders. We have chosen Supabase's Sydney, Australia region, so this data is stored in Australia.
  • Google — supplies the web fonts used across the site and the embedded map on our contact page. Loading these means your browser contacts Google's servers, which will see your IP address. We may also add Google Analytics to understand how the site is used; if we do, this policy will be updated first.

We may also disclose personal information where we are required to by law, or to protect our legal rights.

6. Overseas storage

Your order details are stored in Australia. We deliberately chose the Sydney region for our order database so that the personal information you give us when ordering — your name, contact details and address — stays onshore.

No payment data goes anywhere at all, because this website does not process payments. Some other things do still involve overseas providers:

  • Web3Forms, which carries your message or the order notification from the website to our shop inbox, operates outside Australia. Those contents pass through it in transit.
  • Google, which serves the fonts and the map on our contact page, is a global service. Loading those means your browser contacts Google servers overseas, which will see your IP address.

We take reasonable steps to use reputable providers with appropriate data protection practices. However, once information is held or handled overseas it may be subject to the laws of that country, and we cannot guarantee those laws offer the same protections as Australian privacy law. By placing an order or sending us a message through this website, you consent to this overseas disclosure.

7. How we protect it

We take reasonable steps to protect personal information from misuse, loss, and unauthorised access:

  • The website is served over an encrypted HTTPS connection
  • Access to order records is limited to the staff who need it to prepare orders
  • Our order management system is protected by individual staff logins
  • Our service providers are chosen for their security practices

No method of transmitting or storing information is completely secure. While we work to protect your information, we cannot guarantee absolute security. If we become aware of a data breach that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

8. How long we keep it

We keep order records for as long as we need them to run the business and meet our tax and record-keeping obligations — generally five years, and longer if a dispute or legal requirement makes it necessary. Contact-form messages are kept only as long as we need them to deal with your enquiry.

When we no longer need your personal information, we take reasonable steps to destroy it or permanently de-identify it.

9. Cookies and your browser

This website does not set advertising or tracking cookies.

Your shopping cart is stored in your own browser using local storage. It stays on your device, is never transmitted to us until you actually place an order, and clearing your browser data removes it.

Third-party content on the site — the Google Fonts we use for typography and the Google Map on the contact page — may set cookies or record your IP address under Google's own privacy policy. You can block these in your browser settings, though the map and the site's fonts may not display correctly if you do.

If we add Google Analytics in future, it will set analytics cookies. We will update this policy before that happens.

10. Marketing emails

We may occasionally email you about specials, seasonal produce and shop news — but only where you have consented, or where you are an existing customer who would reasonably expect to hear from us about our products.

Every marketing email we send will identify us clearly and include a working unsubscribe link, as required by the Spam Act 2003 (Cth). Unsubscribing takes effect within five business days at the latest. You can also ask us to stop at any time by emailing info@balgowlahseafood.com.au.

Unsubscribing from marketing does not stop us contacting you about an order you have actually placed.

11. Access and correction

You have the right to ask us what personal information we hold about you, and to ask us to correct it if it is wrong, out of date, or incomplete.

Email info@balgowlahseafood.com.au or call 0424 997 771. We will respond within a reasonable period, normally 30 days. We may need to verify your identity first. There is no charge for making a request, though we may charge a reasonable fee if a request requires substantial work.

If we refuse a request, we will tell you why in writing and explain how to complain about that decision.

You can also ask us to delete your personal information. We will do so unless we are required to keep it — for example, sales records we must retain for tax purposes.

12. Complaints

If you think we have mishandled your personal information, please tell us first. Email info@balgowlahseafood.com.au with the details and we will investigate and respond, normally within 30 days.

If you are not satisfied with our response, you can take the matter to the Office of the Australian Information Commissioner:

13. Changes to this policy

We may update this policy as the business or the website changes — for example, when our online order system goes live, or if we add analytics. The current version is always on this page, with the date it was last updated at the top. Significant changes affecting how we use information you have already given us will be brought to your attention.
